The one-sentence version: Consent on Leadova means you said yes — clearly, knowingly, and freely — and you can say no at any time, for any reason, with immediate effect.
1. What "Consent" Means on Leadova
Consent is the foundation of everything we do. Without it, we have nothing.
On Leadova, consent means that a person — a potential lead — has been told what information is being collected, who will see it, and why, and has actively agreed to proceed. We do not assume consent. We do not use pre-ticked boxes. We do not bury consent in fine print.
This matters for a simple reason: the businesses that subscribe to Leadova pay for leads who actually want to be contacted. Coerced or confused consent produces bad leads. Genuine consent produces conversations that lead to placements.
This policy explains how we capture consent, what we record, and how you can withdraw it.
2. The Three Pillars: Explicit, Informed, Voluntary
Explicit
You take a clear, active step: checking a box, signing a form, or verbally confirming. No passive consent, no assumed agreement.
Informed
Before you consent, you know exactly what data is collected, who sees it, and what they can do with it. No surprises after the fact.
Voluntary
You are never pressured, tricked, or coerced. Saying no has no consequences. You can stop at any step, at any time.
These three pillars align with the requirements of the Philippine Data Privacy Act (RA 10173), which defines valid consent as freely given, specific, informed, and an unambiguous indication of agreement.
3. How Consent Is Captured Across Channels
Leadova collects leads through multiple channels. Each channel has a defined consent capture method that we document and store.
Web Form (Landing Page)
A clearly labeled consent checkbox is presented before the submit button. The checkbox text explicitly states what you are consenting to, links to this Consent Policy, and cannot be pre-checked. Submission is blocked if the checkbox is not checked. We record: timestamp, IP address, browser/device fingerprint, consent text version shown.
Field Agent (Physical / In-Person)
The agent reads or presents a standardized consent disclosure to the prospect before collecting any information. Consent is documented via: a signed paper form (photo captured and uploaded), a digital signature on a mobile device, or a verbal acknowledgment captured by audio recording (where legally permitted). The agent records their own ID, the date, time, and location of collection.
AI Chatbot / Conversational Interface
The chatbot presents the consent disclosure as part of the conversation flow. The prospect must respond with an affirmative statement (e.g., "I agree," "Yes," "Oo") before data collection continues. The full conversation transcript — including the consent statement and the prospect's affirmative response — is stored as the consent record, timestamped to the second.
3.1 What the Consent Disclosure Says
At every consent capture point, in plain language, we tell you:
- That you are submitting your information to Leadova's lead generation platform
- Which vertical (e.g., OFW Employment) your profile will be enrolled in
- That subscribed businesses in that vertical will be able to view and contact you
- That you can withdraw consent at any time by emailing privacy@leadova.com or clicking an unsubscribe link
- A link to this Consent Policy and our Privacy Policy for full details
4. Your Consent Record
Every consent event generates a permanent audit record. This record is your proof that Leadova and subscribed businesses have a legal basis to contact you — and it is your protection too, since it defines the exact scope of what you agreed to.
Your consent record includes:
- Date and time of consent (to the second, in UTC+8)
- Channel through which consent was captured (web, agent, chatbot)
- Consent text version that was shown or read to you at the time
- Evidence of consent (form submission log, signed document image, or chatbot transcript)
- Vertical you consented to be enrolled in
- Agent ID (if collected by a field agent)
You may request a copy of your consent record at any time by emailing privacy@leadova.com.
5. How to Withdraw Consent
Withdrawing consent is free, permanent, and takes effect immediately. No reason required.
Send "I withdraw my consent" to privacy@leadova.com from the email address on your profile. We will confirm receipt within 24 hours and complete removal within 48 hours.
In-App (if you have account access)
Navigate to your profile settings and click "Withdraw Consent." Your profile is immediately deactivated and scheduled for deletion.
One-Click Unsubscribe
Every communication from Leadova or a subscribed business includes a one-click unsubscribe link. Clicking it withdraws your consent immediately and removes you from all future contact.
Via a Field Agent
If you were enrolled through a field agent, you can contact that agent directly or contact us at privacy@leadova.com. The agent is required to process withdrawal requests immediately.
Important: Withdrawal of consent only applies going forward. It does not undo any contacts that legitimately occurred before your withdrawal while your consent was active. If a business contacts you after you have withdrawn consent, that is a violation of our Terms of Service — please report it to privacy@leadova.com immediately.
6. What Happens After You Withdraw
When we receive your withdrawal request:
- Immediate: Your profile is flagged as "consent withdrawn" and hidden from subscriber search results within minutes
- Within 48 hours: Your profile is permanently removed from the active lead database
- Within 72 hours: All businesses that accessed your profile are notified that your consent has been withdrawn and that they must cease all contact
- Within 3 business days: You receive a confirmation email documenting the withdrawal
- After 12 months: The minimal audit record (your name + withdrawal timestamp) is permanently deleted
You may re-consent at any time after withdrawal by re-submitting your profile through a Leadova channel. Your new consent will be treated as a fresh record, independent of any prior history.
7. Business Obligations Regarding Consent
Subscribing businesses access lead data under strict obligations tied to the consent framework:
- Contact only while consent is active: Businesses may only contact leads whose consent has not been withdrawn
- Honor withdrawal immediately: Upon receiving a withdrawal notification from Leadova (or directly from the lead), businesses must cease all contact within 24 hours
- No data laundering: Consent to be on Leadova does not mean consent to be added to any other database. Businesses may not export Leadova lead data into their own CRMs for use outside the context of Leadova-facilitated introductions
- Scope limitation: A lead's consent is specific to a vertical. A lead who consented to OFW Employment inquiries has not consented to be contacted about Real Estate, even if the same business operates in both verticals
Violations of these obligations are grounds for immediate subscription termination and may result in legal action. See our Terms of Service for full subscriber obligations.
8. Consent Audit Trail
Leadova maintains a complete, tamper-evident audit trail for every consent event on the platform. This serves two purposes:
- Compliance: Under RA 10173 (Philippine Data Privacy Act), we are required to demonstrate that consent was properly obtained. Our audit trail is designed to satisfy this requirement and to survive regulatory scrutiny.
- Protection: If a dispute ever arises — whether a lead claims they never consented, or a business claims a lead was willing — the audit trail is the authoritative record of what happened.
Consent audit records are retained for 5 years from the date of consent, or 12 months from the date of withdrawal (whichever is later), after which they are permanently deleted.
Audit records are not accessible to subscribing businesses. They are internal compliance records only, accessible to Leadova's privacy team and, upon request, to regulatory authorities.
9. Why This Matters (The Philosophy)
Consent isn't a legal checkbox for us. It's the entire business model.
The lead generation industry has a long history of gray-area practices: scraped contact lists, purchased databases, data brokers with no audit trail, and businesses cold-calling people who never asked to be contacted. That model destroys trust and produces terrible conversion rates.
Leadova exists on the opposite premise: a warm lead who wants to be contacted is worth ten cold leads who don't. Our consent infrastructure isn't overhead — it's the product. When a business on Leadova contacts someone, they know that person agreed to be contacted. That changes the entire tenor of the conversation.
Protecting consent rights is also the right thing to do. People deserve to control who contacts them about their employment, finances, housing, and personal services. We take that seriously.
10. Questions or Concerns
If you have any questions about consent, believe your consent rights have been violated, or want to request a copy of your consent record:
- Email: privacy@leadova.com
- Response time: Within 24 hours for consent withdrawal requests; within 15 business days for all other inquiries
If you believe a subscribing business has contacted you after you withdrew consent, or has misused your data, please email us with details and we will investigate immediately. This is a Terms of Service violation and we take it seriously.
You also have the right to escalate to the National Privacy Commission of the Philippines at www.privacy.gov.ph.
