1. Acceptance of These Terms
By accessing or using Leadova's platform at leadova.polsia.app (the "Platform"), submitting a profile, subscribing as a business, or acting as a field agent, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a binding legal agreement between you and Leadova. You must be at least 18 years old to use this Platform.
2. Platform Description
Leadova is a consent-first lead generation platform. We operate across industry verticals — beginning with OFW (Overseas Filipino Worker) Employment and expanding to other sectors including Local Employment, Real Estate, Insurance, Solar, Education, Legal services, and others.
The Platform has three distinct user types, each subject to different obligations:
- Leads (Data Subjects): Individuals who voluntarily submit their personal and professional information to be discovered by relevant businesses
- Subscribers (Businesses): Companies or individuals that pay a subscription fee to access and contact leads within a specific vertical
- Agents: Authorized individuals who collect lead information on behalf of Leadova using physical forms, verbal consent, or AI-assisted tools
3. Terms for Leads (Data Subjects)
3.1 Your Agreement When Submitting
When you submit your profile through Leadova, you agree that:
- The information you provide is accurate, current, and your own
- You are submitting voluntarily and have not been coerced or deceived
- You understand that your profile will be visible to businesses subscribed to your vertical
- You have read and understood the consent disclosure presented at the time of submission
- You are at least 18 years old (or the age of majority in your jurisdiction)
3.2 How Your Data Is Used
Your submitted profile will be made available to businesses that have subscribed to the vertical you are enrolled in. Subscribing businesses may view your contact information, professional background, and submitted preferences, and may reach out to you regarding opportunities relevant to that vertical.

3.3 Your Right to Withdraw
You may withdraw your consent and request removal of your profile at any time. Withdrawal is permanent and free. We will remove your profile from the active database within 48 hours and notify businesses that had accessed your profile. Full instructions are in our Consent Policy.
3.4 Accuracy Obligation
You are responsible for the accuracy of information you submit. Providing false information — including false credentials, fabricated work history, or another person's identity — is a violation of these Terms and may result in your profile being removed and, where applicable, reported to relevant authorities.
4. Terms for Subscribers (Businesses)
4.1 Subscription and Access
Subscribers pay a recurring fee for access to the lead database within a specific vertical. By subscribing, you agree that:
- Access is granted to your designated vertical only — you may not access leads from verticals you have not subscribed to
- Your subscription is non-transferable and may not be shared with third parties
- Access terminates upon subscription cancellation or non-payment; no refunds are issued for unused periods except as required by applicable law
4.2 Acceptable Use of Lead Data
When you access leads on Leadova, you agree to:
- Contact leads only regarding opportunities that are directly relevant to the vertical you subscribed to
- Comply with all applicable laws governing direct marketing, cold outreach, and employment solicitation
- Honor withdrawal requests immediately — if a lead notifies you that they have withdrawn consent, you must cease all contact within 24 hours
- Handle lead data with reasonable security measures and not store it on unsecured systems
- Not share, sell, rent, or transfer lead data to any third party
4.3 Prohibited Subscriber Actions
These actions will result in immediate suspension and may result in legal action:
- No reselling: You may not sell, license, or share Leadova lead data with any other party under any circumstances
- No spamming: Contacting leads repeatedly after they have indicated they are not interested or after withdrawal constitutes harassment and violates this agreement
- No misrepresentation: You may not impersonate another business, provide false information about your services, or mislead leads about the nature of any opportunity
- No unauthorized access: You may not attempt to access leads outside your subscribed vertical, reverse-engineer the platform, or circumvent access controls
- No cross-vertical targeting: Data obtained through Leadova may only be used for the vertical it was provided under
4.4 Business Verification
For regulated verticals (including OFW Employment), Leadova may require verification of your business license, permits, or accreditation before granting access. Providing false documentation is grounds for immediate termination and may be reported to relevant regulatory authorities.
4.5 Subscriber Liability
You are solely responsible for how you use lead data after accessing it through our Platform. Leadova provides data access in good faith and is not liable for any harm arising from a subscriber's misuse of that data. Subscribers indemnify and hold Leadova harmless from any claims arising from their use of lead data.
5. Terms for Field Agents
5.1 Agent Role and Authorization
Field agents collect lead information on behalf of Leadova in physical or digital contexts. If you are acting as an agent, you must be explicitly authorized by Leadova and have agreed to a separate agent agreement.
5.2 Consent Capture Obligations
Agents are required to:
- Obtain explicit, informed, voluntary consent from every person whose information they collect
- Clearly explain what data is being collected, why, and who will access it
- Document consent using the method specified (digital signature, verbal recording, photo of signed form)
- Never collect information from anyone under 18 years of age
- Never fabricate, alter, or submit information without the subject's knowledge and consent
- Immediately report any suspected coercion or ethical violations to Leadova
5.3 Data Handling by Agents
Agents may not retain copies of lead data beyond what is necessary for the submission process. All collected data must be submitted to the platform and not stored on personal devices, unauthorized cloud services, or shared with unauthorized parties.
5.4 Agent Liability
Agents who collect data without proper consent, falsify records, or misuse lead data are personally liable for any resulting harm and may face civil and criminal liability under the Philippine Data Privacy Act and related laws.
6. Prohibited Uses — All Users
Regardless of your user type, you may not:
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Platform
- Scrape, crawl, or harvest data from the Platform using automated means
- Introduce malware, viruses, or malicious code
- Attempt to interfere with the integrity or availability of the Platform
- Use the Platform to harass, threaten, or harm any other person
- Circumvent or attempt to circumvent our consent infrastructure
7. Intellectual Property
Leadova and its licensors own all intellectual property rights in the Platform, including its design, code, branding, and platform architecture. Nothing in these Terms transfers any intellectual property rights to you.
Lead data remains the personal data of the individuals who submitted it. Leadova licenses access to this data to subscribers; it does not assign ownership.
You may not reproduce, copy, or redistribute any part of the Platform without our prior written consent.
8. Disclaimers
The Platform is provided "as is" and "as available." Leadova makes no warranties, express or implied, regarding:
- The accuracy or completeness of lead profiles (we QA-check but cannot guarantee all information is current)
- The availability of the Platform (we aim for high uptime but cannot guarantee uninterrupted access)
- The outcome of any business relationship formed through leads discovered on our Platform
- The suitability of any lead for any particular business purpose
Leadova is a platform intermediary. We do not employ leads, endorse any business, or guarantee any placement outcomes.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Leadova shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform.
Our aggregate liability to you for any claims arising from these Terms or use of the Platform shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) ₱5,000 PHP.
Nothing in these Terms limits liability for fraud, gross negligence, or violations of applicable consumer protection or data privacy laws that cannot be limited by contract.
10. Dispute Resolution
We want to resolve disputes informally where possible. If you have a dispute with Leadova, please contact us at legal@leadova.com and give us 30 days to resolve it before initiating formal proceedings.
If informal resolution fails, disputes shall be submitted to binding arbitration in accordance with Philippine law, or resolved by the courts of competent jurisdiction in the Philippines.
For disputes concerning data privacy rights, you may also escalate to the National Privacy Commission of the Philippines.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, including but not limited to the Data Privacy Act of 2012 (RA 10173), the Electronic Commerce Act (RA 8792), and the Consumer Act of the Philippines (RA 7394), without regard to conflict of law provisions.
12. Modifications to These Terms
We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email (if we have your address) and a prominent notice on the Platform. Your continued use after the effective date constitutes acceptance.
If you are a subscriber, material changes to terms affecting your subscription will be communicated at least 30 days in advance, and you may cancel your subscription without penalty if you do not accept the changes.
